Marlboro Man Joins Subway Footlong Lawsuit

When Jason Leslie of Marlboro saw a photo online with a measuring stick and a Subway Footlong sandwich, he decided to conduct his own experiment.
Leslie ventured to a local Subway restaurant and found he was getting less than the advertised 12 inch sandwich. In fact, five percent less.
According to The Asbury Park Press, Leslie filed a class action suit on Wednesday in U.S. District Court in New Jersey with his lawyer Gerald A. Marks of Marks & Klein in Red Bank.
Leslie told The New York Post that he's eaten 50 Subway sandwiches per year for 14 years.
“The sandwiches are anywhere between a half-inch to an inch shorter . . . I feel cheated," he told the NY newspaper.
According to the APP, Leslie has bought the now infamous $5 Footlong Subway sandwiches in stores around Monmouth and Middlesex Counties, including Freehold, Marlboro and Howell.
Subway made $11.4 billion in 2011, according to the Quick Service Restaurant Trade Journal. It has not been reported how much Leslie is seeking from the class-action suit.
A statement released by Subway said, “We have redoubled our efforts to ensure consistency and correct length in every sandwich we serve. Our commitment remains steadfast to ensure that every Subway Footlong sandwich is 12 inches.”
Leslie told The New York Post he felt "like an idiot" for falling for the footlong advertisement.
“They advertise in all these commercials, ‘Footlong, Footlong, Footlong,’ and now I feel like an idiot. I can’t believe I fell for that trick."

I agree, and assume this person is likely considered a loser by most peers. This is the problem with the world today. Too many Lawyers and fraudulant claims. People looking to make money for nothing...what happened to hard work...? When any deli buys bread they order a 6 " 7" or 8" sub roll from the bakery, but the bread never comes in the same way twice, it happens everywhere, but sue subway because they will pay you more than the deli down the road right? GET OVER IT ! sometimes you win and soetimes you lose. Its called LIFE, to many softies today, America is turning into land of the sissy cry-babies. This guy is likely a liar and a loser and probably and attorney or related to one.

let's see 14 years x 50 per year = 700 sandwiches.
1/2" = 1/24 of a sandwich
1/24 of a sanwich = $0.208
$0.208 x 700 = $145.83
That;s fair. give hin the $145 and he gets to pay his lawyer and court costs that run in the thousands.
Just another idiot trying to extort money from a corperation. Good thing he didn't order some hot coffee.

I like the direction this heads! Poor Jason! Your bread was a little short. Your turkey sandwich still had it's eight slices of turkey. And I am sure they put everything in it you asked for. It must have been perfect; or at least good enough for you. After all, you ate it for 14 years at 50 sandwiches a year. My point here is this. If this sandwich came up short, it was only on the bread. The amount it came up short is only in the bread. The article says "5%" less. Ok I don't know what the subway sandwich roll actually cost so lets use store bought rolls. I can buy a 6 pack of 6" hoagie rolls (They are actually a little bigger than 6". We can sue them later.) for $2.00. This would make 3 footlong sandwiches at $.66 for the bread on each sandwich. $.66 x 5% = $.03. The way I see it, 14 years x 50 sandwiches x $.03 = $21.00. After the lawyer gets his cut, he should still be able to go buy a footlong combo meal. One other thing, I have seen a lot of pictures with rulers showing short sandwiches. Look at those pictures again. I measured my sandwich for the fun of it an realized something. The white paper they make your sandwich on is 12" wide. I measured it along with my sandwich. I think that parchment paper is probably standard for all of their restaurants. If you use that to measure with, even the sandwich picture that started all of this measures up to the "12 standard."

They put the same amount of meat on - no matter what the size bread. I am sure the amount of dough is the same - it just baked shorter and fatter (a product of baking). Subways lawyers should be all over this - we live in such a "sue everyone" society it is sickening

There's a dirty joke in here somewhere. Why don't sue your parents and every mall that has a Santa Claus or Easter Bunny. How about every "reality" TV show that's fake? Or our government officials? "I did not have sex with that woman" - Bill Clinton. We know that was lie! There are a lot more import things our courts could be doing the worrying about one bite of a sub. They should be working on getting people the monies to rebuild their homes from insurance companies, not worrying about a bite of of a sandwich! Some people don't even have homes! Typical Marlboro scum!
